Terms and Conditions of Sale

These terms and conditions of sale (hereinafter "Terms") apply to any order of cosmetic products placed on the bellarte-boutique.ch website by a consumer customer (hereinafter "the Customer"), excluding purchases made for professional or commercial purposes.

By placing an order on our site, the Customer acknowledges having read these Terms and accepts them without reservation. Institut Bellarte reserves the right to modify the Terms at any time. The applicable Terms are those in force at the time the order is confirmed.

The products offered for sale are the cosmetic products described on the site at the time of consultation by the Customer. Each product page presents the essential characteristics of the product (composition, use, volume).

Product offers are valid while stocks last. If a product becomes unavailable after the order is confirmed, Institut Bellarte undertakes to inform the Customer as soon as possible and to offer either a substitute product of equivalent quality and price, or a full refund of the amounts paid.

Photographs and visuals of the products on the site are provided for illustrative purposes. Slight variations in shade or packaging may exist without affecting the essential properties of the product.

Prices are indicated in Swiss francs (CHF), all taxes included. Institut Bellarte reserves the right to modify its prices at any time; products will be invoiced based on the rates in effect at the time the order is confirmed.

Shipping costs are not included in the price of the products and are indicated separately during the order process, before the purchase is confirmed (see article 07).

The order is placed in several steps:

1. Selecting products and adding them to the cart
2. Checking the cart contents and quantities
3. Signing in to your account or ordering as a guest
4. Entering the delivery address
5. Selecting the payment method (card, TWINT, PostFinance, Apple/Google Pay, PayPal) and confirming payment on the secure Payrexx page
6. Order confirmation by email

The order is definitively confirmed at the time of payment. An order confirmation summarizing the products ordered, the total price and the delivery address is sent by email within minutes of confirmation. This confirmation serves as an acknowledgment of receipt but does not constitute formal acceptance within the meaning of the Swiss Code of Obligations until shipment.

Institut Bellarte reserves the right to cancel or refuse any order from a Customer in the event of a dispute relating to the payment of a previous order or suspicion of fraud.

Payment is due immediately upon ordering. The accepted payment methods are:

• TWINT — Swiss mobile payment
• Visa card
• Mastercard
• American Express
• Institut Bellarte gift card (promo code applied to the cart)

Transactions are fully secured and processed by Payrexx AG (Thun, Switzerland), a PCI-DSS certified Swiss payment provider. Institut Bellarte never stores your banking details. If payment is declined by the financial institution, the order is automatically cancelled and the Customer is informed.

Invoicing is issued in Swiss francs (CHF) and an electronic invoice is available in your customer account after shipment.

Deliveries are made within Switzerland only. For any international delivery request, please contact us directly at info@boutique-bellarte.ch.

Orders are prepared and shipped within 24 to 48 business hours after payment confirmation. A shipping confirmation email is sent to the Customer when the parcel is dispatched.

If no one is present at delivery, the parcel will be left in your mailbox or at the nearest post office. Institut Bellarte cannot be held liable for delays attributable to the carrier or to external circumstances (weather, strikes, force majeure).

Digital gift cards are delivered exclusively by email, immediately after payment confirmation.

Institut Bellarte grants the Customer a right of return of 14 calendar days from receipt of the parcel. This right is subject to the following conditions:

• The product must be in its original packaging, intact and unopened
• For hygiene reasons, opened products or those with a broken seal are not accepted for return
• Digital gift cards and personalized products are neither exchangeable nor refundable

To exercise this right, the Customer must contact Institut Bellarte by email at info@boutique-bellarte.ch, stating the order number and the products concerned. Return costs are borne by the Customer, except in the event of an error on our part or a defective product.

The refund is made within 14 days of receipt and inspection of the returned parcel, using the same payment method used for the order.

In accordance with articles 197 et seq. of the Swiss Code of Obligations, Institut Bellarte is bound by a 2-year legal warranty for any defect in the item sold that existed at the time of delivery. In the event of a proven defect, the Customer may request a price reduction, replacement of the product, or termination of the contract.

This warranty does not apply to defects resulting from improper use, unsuitable storage, or an individual reaction to a cosmetic ingredient. We encourage you to review the ingredient list before any purchase if you have a known allergy.

Gift cards purchased on bellarte-boutique.ch are valid on all products in the online shop. They are personal, non-refundable and non-exchangeable for cash. They are valid for 12 months from the date of purchase. Any unused balance is forfeited upon expiry.

In the event of loss or theft of the gift card code, Institut Bellarte cannot be held liable. Any gift card code that has been used is considered consumed.

Promotional codes are valid once per customer, cannot be combined with each other or with other current offers, and are only applicable under the conditions specified when issued. Institut Bellarte reserves the right to deactivate any promotional code used abusively.

Institut Bellarte cannot be held liable for damages of any kind, direct or indirect, resulting from improper use of a product, an individual skin reaction to an ingredient, or temporary unavailability of the site. The cosmetic advice provided via our online diagnostic tool is indicative and does not replace the advice of a healthcare professional or a dermatologist.

These Terms are governed by Swiss law. In the event of a dispute relating to the formation, performance or interpretation of an order, the parties shall endeavor to find an amicable solution. Failing that, the dispute shall be brought before the competent courts of the canton of Neuchâtel (Switzerland).

For any consumer dispute, the Customer may also turn to a consumer mediation body or the European online dispute resolution platform (for customers residing in the EU), accessible at ec.europa.eu/consumers/odr.
